A disclosure policy for fitness creators that triggers on benefit, not on format
Write a fitness creator disclosure policy for payments, gifts, affiliate links and own-brand posts, with format checks and correction routes.
A useful disclosure policy tells editors what counts as a commercial connection, where the audience must see it, who checks it and what happens after a mistake. A footer saying that a site "may use affiliate links" does not identify the affected item when someone encounters it.
Research closed on 5 September 2026 for UK-facing fitness content operated from England. Named advertising and consumer-law reviewers must approve the policy. A registered health professional must assess any health claim; disclosure does not substantiate it.
What to take away
- Define disclosure triggers by the benefit received, not by the content format.
- Label advertising clearly on every surface where the audience may encounter it.
- Separate connection disclosure from health claim review and require evidence for claims.
- Record platform settings and check them against UK label requirements.
- Name an owner who can stop, relabel, edit or remove content and log corrections.
- A clear Ad label cannot rescue an unproven injury, weight-loss or performance promise.
Define the trigger by benefit, not format
Require the creator to declare money, commission, gifts, discounted services and loans before briefing begins. Also declare free membership, event access, ownership, employment and other interests. The CMA's endorsement guidance for creators covers free and discounted products, other incentives and own-brand promotion.
The disclosure register should capture the provider, benefit, date received, affected product and agreed content. It should also record the affiliate window and the owner. Do not decide disclosure by follower count or by whether the brand dictated the words. Do not let the creator or agency decide that an unsolicited gift is irrelevant without review.
A single gifted pair of shoes does not make every later post an advert forever. A continuing relationship or affiliate link may reach beyond the sentence nearest the link.
Write an entry-point rule
The audience should recognise advertising before deciding to click, watch, read or buy. ASA guidance on recognising influencer advertising expects prominent, upfront and understandable identification where content is an advert. It advises against relying on a profile biography, previous posts, a brand tag or unclear abbreviations.
Set the minimum label as clear advertising language such as "Ad", subject to review in the actual context. Apply it to every surface through which the item may be encountered:
| Format | Check before release |
|---|---|
| Short video | first visible frame, spoken opening and caption |
| Long video | thumbnail or title, opening and description |
| Image or carousel | first image and caption before truncation |
| Livestream | opening, persistent treatment where practical and repeated verbal notice |
| Article or email | heading area before endorsements or purchase links |
| Affiliate page | affected product discussion, link and code context |
This table is an editorial implementation rule, not a regulator-approved safe harbour. Test desktop, mobile, muted playback and logged-out view. Also test the repost and the embedded view. If the label disappears behind a "see more" control, a muted opening or a cropped frame, stop publication.
Separate connection disclosure from claim review
After adding the label, review every promise about pain, injury, strength or weight. Cover recovery and mental health promises in the same check. CAP Code Section 12 requires objective health claims in marketing to carry evidence. It also limits advice or treatment for conditions needing medical supervision.
Mark each statement as factual description, subjective opinion, objective performance claim, health claim or medicinal claim. Remove pain-free, safe for everyone or guaranteed transformation claims unless a reviewer finds claim-matched support.
A gifted-product notice does not prove a supplement works. "My experience" may still convey an objective result in context.
The policy should require a claim ledger containing the exact wording, evidence, intended audience and limitations. It should also name the health reviewer and the expiry date. Ban publication if the supporting record cannot be found.
Review the whole consumer offer
Check the total price, recurring payments, eligibility, minimum term and cancellation terms. Also check restrictions, scarcity statements and the refund route. The CMA's guidance on unfair commercial practices explains the regime that applies from 6 April 2025. It covers misleading actions and omissions and practices that are always unlawful.
A limited creator experience is not a general result. Where a before-and-after image is used, establish permission, dates, editing history, conditions and the precise claim it carries.
Cover children and vulnerable audiences
Record the intended and likely audience. CAP Code Section 5 defines a child as under 16 for that section and includes rules on harm, dangerous imitation, exaggerated attainability and direct appeals to buy. Do not treat an age statement in a caption as proof that children will not encounter a fitness challenge.
Require safeguarding and consumer review when appearance, weight or performance messages may be received by children or vulnerable adults. Narrowing the audience may be safer than adding more warning text.
Add platform controls without relying on them
The policy owner must check both the UK label and the live platform setting. YouTube requires notification of relevant paid product placements and endorsements. TikTok's creator-programme policy requires the commercial content disclosure setting for branded content. Record the version and market checked because these private terms can change. Platform acceptance is not approval under consumer or advertising law.
Specify corrections and enforcement
Name the person who can stop, relabel, edit or remove an item. Preserve a screenshot, URL, release time and approved file hash. Keep the benefit record and the reviewer decisions with it. If a disclosure fails, correct every live surface, notify the brand, assess consumer impact and log whether wider content has the same defect.
The release record should name the health, advertising and consumer reviewers and the time checked. Reopen the review after any edit to the claim, label or audience. Reopen it again for price, link or platform format changes.
Review the policy at least when regulator guidance, platform display, affiliate arrangements or content formats change. Run a publication-day check on every item. Keep it on hold when the commercial connection, label placement, claim evidence or accountable owner cannot be established.
Before you act
- Declare all benefits before briefing begins.
- Apply a clear advertising label on every entry point.
- Review health claims separately and keep a claim ledger.
- Review the whole consumer offer.
- Record intended and likely audience, including children.
- Check UK label and live platform setting.
- Name the person who can stop or relabel content.
Common questions
What should a disclosure register capture?

How should health claims be handled after adding a disclosure label?
Review every promise about pain, injury, strength or weight. Cover recovery and mental health promises in the same check. CAP Code Section 12 requires objective health claims to have evidence. A gifted-product notice does not prove a supplement works. Require a claim ledger and ban publication if the supporting record cannot be found.
What platform controls must the policy owner check?
The policy owner must check both the UK label and the live platform setting. YouTube requires notification of paid product placements and endorsements. TikTok's creator-programme policy requires the commercial content disclosure setting for branded content. Record the version and market checked.
